Requirement of Background Checks for Private Gun Sales a “Challenge to Constitution”

The city of Missoula, Montana recently passed an ordinance that requires background checks on all private gun sales within the city limits. (Note: I’ve been unable to find the actual text of the ordinance, but here’s some information about it.) Through legal channels, it has been requested that the Montana Attorney General investigate and come up with an opinion as to whether or not this requirement imposed on private gun sales is in conflict with the Second Amendment and the Montana Constitution.

“Knudsen says he has been concerned with Missoula’s proposed ordinance for over a year, and that the issue may come up in the next legislative session.

“The Second amendment and Firearms are a very big deal to me personally and I think that this is an important issue,” Knudsen said. “Any time you start messing with people’s Second Amendment rights, not only under thee Second Amendment to the U.S. Constitution, but also under the Montana Constitution, people have the right to keep and bear arms…when you start messing with that, people get upset. I think there is definitely a possibility that the legislature could do something.”

Fox has already issued the following statement regarding the ordinance.

“Contrary to the opinion of the City Attorney, whom I respect, I believe that Missoula’s proposed gun control ordinance is prohibited by state law and likely violates our constitutional right to keep and bear arms.”“<<<Read More>>>

Of Course Question 3 Won’t Work Without Gun Registration

“According to an article in last week’s Las Vegas Review Journal, the Guinn Center, an independent think tank, took a close look at the Question 1 gun control ballot initiative in Nevada. Question 1 is practically identical to the Question 3 ballot initiative in Maine. The study said this about Nevada’s version of Question 3:

The TRUTH of Question 3 & Universal Background Checks

“While the anti-gunners say this law is needed to keep guns out of the hands of criminals, the Federal government’s own data shows that few criminals obtain guns through private sales; far more acquire them through background-checked dealer sales, by sending a person with a clean record to buy the gun. The real reason Bloomberg wants this law is that it is the key step toward mandatory gun registration. In fact, there’s no way this law can be enforced without gun registration.”<<<Read More>>>

*Editor’s Note* – I concur that the reason Bloomberg (he’s a nanny himself to the rulers over him) wants to pass this law is “mandatory gun registration”…to begin with. The real goal here is gun confiscation. Registration is needed first in order to carry out confiscation, i.e. the tyrant bastards have to know where to go get the guns. If you purchase ammunition with a credit/debit card, you have “registered” that sale and thus told people like Bloomberg, you have a gun. Think about it…or are you tolerant of that and willing to give up that portion of your Second Amendment right? You are playing into THEIR RIGGED SYSTEM.

But, please bear in mind that in the process toward gun confiscation, the real goal in foisting this nonsense onto Maine people, is to get a better sense of what they will tolerate. Each time discussion comes up about Question 3, the gun snatchers learn how much more of the Second Amendment they are willing to give up, if for no other reason than thinking it will get rid of maggots like Bloomberg.

ATF Chief Endorses National Database for Gun Owners

The deputy director of the Bureau of Alcohol, Tobacco, Firearms and Explosives said this week that it was a crying shame that Washington politicians had failed to create a national database to track gun ownership in the United States. Thomas Brandon sat down for an interview with CBS’s Sunday Morning program and defended his agency against the claims of some who believe the Obama administration is out to destroy the right to bear arms.

“Public safety is the reason we exist; it’s not to take people’s guns,” said Brandon. “It’s to regulate firearms that can be misused. You know, we’re a small agency with a big job.”

Brandon said that job could be made easier if ATF officials had a searchable database of gun sales. Under current law, the development of such a database is prohibited. Critics say that a national gun registry could easily be the first step on the long road to widespread confiscation. Brandon, however, said that such opposition simply didn’t make sense.<<<Read More>>>

Fascist Mass City Government Severely Infringes on 2A

*Editor’s Note*As readers have learned on this website, this is a classic example of an unconstitutional impairment, a requirement of government, to perform certain acts in order to exercise a constitutional right to keep and bear arms. No other right requires such nonsense. Supreme Court rulings have banned this kind of governmental requirement.

Critics are blasting a Massachusetts city’s new law that they claim requires residents applying for a license to carry handguns to write “an essay” and pay upwards of $1,100 for training.

The new laws take effect this week in Lowell, a city of 110,000 that lies 35 miles north of Boston. Pushed by Police Superintendent William Taylor and passed by the City Council, they require applicants for unrestricted handgun licenses to state in writing why they should receive such a license. Taylor, who was unavailable for comment on Monday, has sole discretion for approving or denying the applications.

Lies and Emotional Drool Over Gun Ownership

*Editor’s Note* – The article linked-to below, specifically the map and supposed “data” used in drawing the map, along with the comments and conclusions made by the author, are absolute garbage. This is a classic example of lying and twisting facts, while disregarding most qualifying data, to come up with a gobbeldy-gook of emotional drool aimed at sensationalizing gun ownership.

Note the quote below that states that in Maine “licensed [gun] dealers” are not required to report transactions. The law requirements for ALL dealers states:

FFL Duties and Prohibitions

Once licensed, federal law requires dealers to:

  • Initiate background checks on unlicensed firearm purchasers;21
  • Maintain records of the acquisition and sale of firearms;22
  • Report multiple sales of handguns (i.e., the sale of two or more pistols or revolvers to an unlicensed person within any five consecutive business day period);23
  • Report the theft or loss of a firearm to the Attorney General and to the “appropriate local authorities” within 48 hours after the theft or loss is discovered;24 and
  • Provide a secure gun storage or safety device with every handgun purchased or sold.25

It is therefore REQUIRED by the Federal Government that a record be maintained by the gun dealer of all gun sales. It is a lie to state otherwise.

In Maine, neither licensed dealers nor private purchasers are required to report the transactions, and who knows how many rifles have been handed down from hunters to their children over the years?
